- Be careful of what you say: At the point of the traffic stop, the officer has very little evidence to hold against you. Many drivers who are under the influence of alcohol will start talking and back pedaling. Not only does this give the officer the opportunity to hear a slur in your voice or smell alcohol on your breath, it gives them evidence to use in court.
